 These Terms and Conditions constitute the regulations referred to in Art. 8 of the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws of 2002, No. 144, item 1204, as amended), and also regulate the conditions for concluding Sales Agreements on the Website, in accordance with the content of other acts appropriately regulating this obligation.

 The Website operates based on applicable law and with respect for good business practices, in particular regarding e-commerce standards concerning the quality of goods and the handling of transactions.

Definitions:

 Terms and Conditions – these Terms and Conditions along with appendices, informing about the obligations and rights of the Parties to the

  • Party – a party to the Agreement is the Customer or the Seller (the term “Parties” refers to the Customer and the Seller collectively).
  • Distance Contract – a contract concluded with the Customer within an organized system for concluding distance contracts, without the simultaneous physical presence of the Parties, with the exclusive use of one or more means of distance communication up to and including the moment the contract is concluded.

  • Customer – a natural person, a legal person, or an organizational unit without legal personality to which the law grants legal capacity, purchasing products or services via the Website.
  • Consumer – a natural person purchasing products or services via the Website for purposes not directly related to their business or professional

§ 1 General Provisions

 The subject of the Website’s activity is the sale of clothing. In matters not regulated by these Terms and Conditions, the relevant legal provisions in force in the territory of the Republic of Poland shall apply, in particular:

  • The Act of 23 April 1964 – Civil Code;
  • The Act of 30 May 2014 on Consumer Rights;
  • Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).

§ 2 Ordering Procedure and Conclusion of the Agreement

 The Customer may place orders on the website 24 hours a day, 7 days a week via the website ter-sarkisian.com.

The Website conducts sales within the territory of the Republic of Poland as well as abroad.

Information about products presented on the Website constitutes commercial information within the meaning of the provisions of the Civil Code. Placing an order constitutes an offer within the meaning of the Civil Code, submitted to the Seller by the Customer.

To place an order, the Customer should use the e-shop available at ter-sarkisian.com. After placing a correct order, the order is considered placed.

Orders are confirmed by e-mail. The moment of concluding the contract is considered to be the sending of feedback to the Customer confirming the acceptance of the order.

Upon receipt of payment, the Seller completes and sends the order within 24 hours (on business days).

§ 3 Payments

 All prices presented on the Website are gross prices, expressed in Polish zlotys (PLN), containing the tax on goods and services (VAT), as determined by separate regulations.

The Website provides for the following types of payments: Online transfers via the Przelewy24 service.

The Customer places an order according to the prices valid at the time of placing the order. The Website reserves the right to change prices. This provision does not apply to orders already being processed.

§ 4 Complaint Procedure (Non-conformity of goods with the contract)

 All complaints related to the purchased goods and questions regarding the use of the Website should be sent to the e-mail address: Tersarkisian@gmail.com. A properly submitted complaint should contain the Customer’s identification (name, surname, address, e-mail) and a description of the complained fact or defect of the goods.

  1. In the case of contracts concluded with Consumers, the Seller is liable for the lack of conformity of the goods with the contract under the terms specified in Chapter 5a of the Act on Consumer Rights.
  2. The Website will respond to the Consumer’s notification within 14 (fourteen)
  3. If the goods are not in conformity with the contract, the Consumer may request their repair or replacement. If repair/replacement is impossible or requires excessive costs, the Consumer may submit a statement of price reduction or withdrawal from the contract (if the non-conformity is significant).
  4. In the case of contracts concluded with Customers who are not Consumers (B2B), the Website’s liability under the statutory warranty is excluded in accordance with 558 § 1 of the Civil Code.

§ 5 Withdrawal from the Agreement (Returns)

  1. A Consumer, based on 27 of the Act on Consumer Rights, who has concluded a distance contract, may withdraw from it without giving a reason and without incurring costs (with the exception of the direct costs of returning the goods) within 14 days from the date of delivery of the subject of the contract.

  • Persistent cookies: stored on the device for the time specified in the file parameters or until deleted by the User.
  • Session cookies: deleted when the session ends (logging out or closing the browser).

§ 7 Final Provisions

The Service Provider reserves the right to make changes to the content on the Website and to possible changes in the price list of products/services offered via the Website, depending on changing average market rates.

The Service Provider is not responsible for:

  1. any damage caused by the violation of third-party rights by Users in connection with the use of the Website;
  2. damage resulting from disruptions in the operation of the Website or its unavailability caused by reasons independent of the Service Provider or resulting from events that the Service Provider was unable to prevent;
  3. any other damage caused by the User’s failure to comply with the provisions of these Terms and Conditions.

A change in the content of these Terms and Conditions may occur after informing Users about the scope of the planned changes no later than 14 days before the date of their entry into force. Orders placed during the validity of the previous version of the Terms and Conditions will be processed in accordance with its provisions.

Any disputes arising between the Seller and a Customer who is a Consumer will be resolved by a common court competent in accordance with the provisions of the Code of Civil Procedure. Any disputes arising between the Seller and a Customer who is not a consumer will be resolved by the common court competent for the registered office of the Website.

The Customer can access these Terms and Conditions at any time via a link on the Website’s home page. All materials on the Website are subject to copyright and are protected by law. Using and disseminating them without the consent of the Website owner is prohibited.

These Terms and Conditions are effective from 01/09/2024.

In a dispute with the Seller, the Consumer has the possibility of an amicable settlement of the matter by: a) applying to a permanent consumer arbitration court; b) mediation; c) applying to the provincial inspector of the Trade Inspection; d) obtaining free assistance in resolving the dispute from the Consumers’ Federation using the free consumer helpline 800 007 707.
